TERMS AND CONDITIONS OF SALE
By accepting this Quote, Customer agrees to these Terms and Conditions of Sale. Final Order and Changes:
Once signed by Customer, this Quote is a final binding Order for the goods and services specified herein SO
PLEASE REVIEW YOUR ORDER CAREFULLY. Customer changes requested to the final Order may incur charges
in addition to this Quote and to be effective shall be in writing signed and agreed to by both you and us.
Payment: All Orders shall be paid in full prior to shipping. Visa, MC, AMEX and Discover are accepted. Once
payment has been submitted it shall be considered a breach of Agreement by Customer to stop, withdraw,
cancel or otherwise contest payment except as may be permitted herein. Unfinished units need to be stained
and sealed on all 6 sides within 72 hrs of receipt of delivery. If you fail to do so the warranty is void.
Cancellations, Returns, and Refunds: Goods which have been stained or installed may NOT be cancelled,
returned or refunded, subject to the express terms of the warranty provided. On cancelled orders or permitted
returns, Customer shall pay a 25% restocking fee and all shipping costs for delivery and return of the goods.
To qualify for a refund on returned goods, the goods must be returned in the same condition in which they
were received by the Customer, in their original packaging, and in accordance with all return terms and
conditions found on Vendors Website: www.Nicksbuilding.com. Please note that “Custom” doors are one of a
kind products that are made to your specifications. Once the manufacturing process has begun, cancellation of
the order will not be allowed. Once a custom door is shipped and installed, no returns will be allowed and all
custom sales are final.
Nick’s Climate Disclaimer :
Due to the many various climates and conditions in which Nick’s custom wood doors are being installed,
please carefully read the following. We strive to do our best to educate and make everyone aware of the
natural characteristics of wood. We cannot offer a warranty on any doors exposed to extremely dry or arid
climates, such as Arizona and other desert type climates. In the U.S. climates can change dramatically based
on location and only the end user knows the type of climate in which the door will be ultimately installed. The
reason we do not warranty the doors in extremely dry or arid climates is not because the doors are inferior or
of poor quality, but because wood is wood, and it will expand and contract based on weather and climate
conditions. This natural characteristic is exaggerated greatly when exposed to extreme dry or arid conditions.
Typical to these areas is an extreme heat, with a very rapid cooling in the evening this is caused by convection
due to low moisture. When this happens especially in the warmer months the doors do not have time to
acclimate to the cooler air which may cause them to have an adverse reaction resulting in failure. This will not
happen with every door every time but there is a possibility of breakdown of the wood or the construction of
the door caused by the aggressive climate change. Again we are just trying to heighten people’s awareness
concerning the natural characteristics and properties that a wood door has. If you are planning on purchasing
a wood door and the door will be utilized in a dry or arid climate with a low humidity you must sign and submit
these Terms and Conditions along with your order to be processed, signifying that you acknowledge that you
have read and understand the Terms and Conditions and restricted warranty in extreme climate zones. Thank

Staining and Finishing of your product :
Nicks does its best to match the stains to the selected colors. It is common knowledge that no piece of wood is
the same. Finishes can come out slightly lighter or darker and this is not considered to be claimable issue. Also
characteristics such as number knots, size of knots, graining and other natural characteristics of wood are not

claimable. Nicks makes no guarantees on the longevity of color and top coat. This is all based on exposure,
climate, and maintenance by the customer. Customer is responsible for maintaining the product to extend the
life of the product.
Delivery :
Seller makes every effort to deliver its product by the expected delivery date, however, the expected delivery
date is an estimate only and delays in delivery shall not relieve Customer of the obligation to accept delivery
of the goods. Local and crated orders involve significant size and weight and the Customer is responsible for
offloading goods from the delivery vehicle. Freight interior orders are prehung initially but they will be
disassembled for shipping purposes to prevent damage. Local delivery (IN) interiors are prehung and are
delivered set in the frames. Liftgate service is available upon advance pre-shipping notice to Seller and
payment in advance of a liftgate service fee of $75. For orders requiring crates longer than 7 feet, liftgate is
not available. All orders will be delivered "Curbside Delivery" to the customer's designated address. Curbside
Delivery means that the truck will park at the curb in the street in front of the delivery address. The freight
carrier does not offer assistance bringing the goods beyond the truck (or curb as applicable), or in unpacking
or setting up the goods. The customer should remove the front sheet of plywood to insure that the product has
not been damaged during transit. If there is any damage you must acknowledge the damage on the driver’s
paper work or we will not be able to file a claim and any repair or replacement costs will be your responsibility.
You may not refuse delivery without discussing with a Nick’s team member first and being granted permission
for refusal. Any refusal made without consulting Nicks first may result in you being responsible for any re
delivery fees.
w.r.t Shipping, Whenever you see listed (from $xxx.xx freight shipping), know that this is an average
calculated freight cost across the continental United States. Your location may be slightly higher or lower than
the average. Shipping charges are subject to change.
Text Communication :
We rely on both text and email communications to send the Quote, confirm the Order and provide shipment
details. By accepting our terms and conditions, you give express consent that Nicks Building Supply may send
you informational text (SMS) messages as part of the normal business operation of your use of the Services
and that use of SMS is necessary to utilize the Services.
You may opt-out of receiving text (SMS) messages from Nicks Building Supply at any time
contacting us at info@nicksbuilding.com. You acknowledge that opting out of receiving text (SMS)
messages may impact your use of the Services.
Warranty :
This Order is made subject to the terms and conditions of the Warranty as set forth at Vendors website at
Nicksbuilding.com, which are incorporated herein by this reference. By accepting this Quote, Customer
acknowledges that it has read and accepts the terms of the Sellers warranty. Any disputes/claims are handled
at Nick’s discretion. Nicks has up to 1 calendar year to settle any disputes/claims. Your order (including these
Terms and Conditions) for which resort to the courts is sought by either party, Vendor and Customer each
agree that personal jurisdiction and venue in any such legal proceedings shall be exclusively in the Circuit or
Superior Courts of Lake County, State of Indiana, and the transaction between the parties shall be governed by
Indiana law.
CUSTOMER ACKNOWLEDGES VENDORS NO REFUND POLICY ON STAINED OR INSTALLED GOODS,
SUBJECT ONLY TO THE TERMS OF THE WARRANT
